Hi
I have just joined after been recommended this site by the CAB.
I have been seperated for 2 year and applied for a divorce due to adultry about 1 year ago.
We were married for 18 year and wish to claim half of his pension.
The 1st solicitor served papers on both my husband and the woman he had an affair with. I dont know if the papers were ever signed because i was silly enough to believe my husband was sorry and agreed to try again so stopped all work. This didnt work but the 1st solicitor i used really wasnt doing anything so nearly £900 later i changed and my new solicitor advised that i should change from adultry to unreasonable behaviour but i would have to pay £150 up front for this.
I have paid the court costs of £350 and now after nearly £1500 want to take this to court myself (represent myself) can you advise me how and if i can do this.

Hi Debsy,

If you gave your arriage another go after the adultery you cannot use this for grounds for divorce as by returning to the marriage you will be viewed as ''accepting'' the adultery. Also, adultery relies on either photographic evidence, a confession or an illegitimate child so its not often advised anyway.

What stage are you at in the divorce?

Hi Thankyou for replying.
I have stopped proceedings as i can no longer afford to pay the solicitor (£1800 later).
Court fees have been paid and both him and the woman were served with papers (i dont know if either of them have even signed them).
I just want to now proceed and be divorced.
I would like to know how i take this to court and represent myself as i cannot continue to pay for legal representation.
How do i do this ?.
Also i bought my ex out of our house and gave him £18,000.

to find out if the paperwork was returned by both parties, you can call the court and ask. It''s very unusual these days to include a co-respondent in a divorce, as you are then relying on two people to admit to adultery, and return the paperwork.
