Hi

I am acting for myself because I can no longer pay for legal assistance.

1. My wife, the applicant, postponed our final hearing in December 2016 on a variety of grounds. This was rescheduled for 19/04/2017. I was to receive her S25 by the 22nd of February in order to respond to it within four weeks of the actual FH date. Once again, we are two weeks beyond the date and I have nothing, or an explanation from her solicitors. This is clearly prejudicing my position, yet the last thing i want to do is postpone again - 2.5 years into this nightmare. Our divorce is characterised by her and her solicitor's last minute cancellations and postponements. Can I ask the court to intervene and force this to a conclusion? I am writing the courts to lodge my dissatisfaction - but is there more I can do ?

2. I have to update my disclosure, which is fine. Is there a specific form I need to do this with ?

3. It is pretty evident to me what has to go into an S25 - Can I /should I just take a stab at it, despite not having one from the applicant to which to respond ?

4. Should I be calling witnesses to my FH?

I will try and help...

1. Things usually end up last minute. You need to chase the solicitor to agree a new date when you will exchange S25 statements.

2. Don't think so, It's usually an update to the relevent amounts/sections on form E. I supplied just a list of updated bank balances and that was deemed as sufficient.

3. You have to do this anyway, and exchange on the same day agreed with your ex. There is an online guide somewhere on this forum that lays it out for you structure wise. It will take time and a few re-drafts to get it reading right.

4. No idea on the procedure for this.

4. Only a judge can agree a witness, call one ect, and its rather rare it happens, even when it does it tends to be an accountant or something of that ilk.

Thanks very much for this. The date set for her to delivery her S25 was over two weeks ago - I then had 4 weeks to respond to it - I will however do the work as best I can.
