Hi I have been advised to write to the courts to state that my ex has ignored an order for his financial disclosure but that I will still be attending the hearing but i know it wont go ahead because of his non dislcosure I have to ask the courts if there should be a further case for his imprisonment for non disclosure- how on earth would i word it without waffling? any ideas? x

Just keep it simple and state the facts. Dear Sir /Madam, you have a hearing on X, according to the Directions order made by Judge Y on DD.MM.YY, disclosure was supposed to happen but has not. You will be attending the forthcoming hearing on DD.MM but are concerned that it may be wasted without disclosure from the other side. I wouldn''t be recommending imprisonment or whatever - just let the court decide what to do. I would guess - they will do nothing until the next hearing when your ex will get a mild slap from the Court and another hearing will be scheduled, more delays etc. Good luck.

Thank you for your reply, unfortunately this will be a second wasted FDR, he has had three extensions to supply his disclosure and a penal notice attatched to the third extension by the courts- so I am hoping he gets more than a mild telling off! I will post what happens on the day x
