We have our FDR on the 29th March my stbx has not given me any paperwork whatsoever- I cannot afford to enforce the courts penal notice on him so I wondered if anyone knew is it too late to cancel the hearing and if there is a charge? x

There is a charge, however the judge will be very firm with your stbx regarding the lack of paperwork etc. A deadline will be set and if they fail to provide the documentation, the courts will set a fine. Courts charge 8% interest so it would be very foolish for your stbx to not provide the info.

Thank you so much for replying, i think at this late stage I shall go to court and see what happens, if this FDR does not happen ( this will be the 2nd attempt at FDR caused by his refusal to supply me paperwork). I am worried that the Judge will give up and send it to FH, which terrifies me as I simply have no funds to get representation! It seems so unfair when I have adhered to all the rules as the repondant and hes the petitioner!! x

Yes it doesn''t bode well for your case I''m afraid, I imagine if your ex is being difficult then it will go to final hearing. They usually say you can bring the horse to the watering hole but you can''t make them drink, but in your case you can''t get them to the watering hole!

I wonder if the judge would be prepared to conduct the FDR just on the basis of your numbers alone? At least then that would give you both a guide as to what might happen in a final hearing, which might scare your ex into settling? I''m not sure if judges would do this - one of the gurus might know...

Thanks for your reply I think your right in saying the judge will just send it to final hearing and just tell the ex he has been very naughty!( I am losing faith in the courts willingless to carry out any orders they have made) Hopefully the court will show me I am wrong! I dont believe a Judge would be able to make a fair settlement based on just my figures as that could possibly be to my detriment should his figures read healthier than mine( If he ever produces any!) But it would be interesting to hear if this is a possibility x

Well it''s not a settlement, just an indication as to what might happen in the final hearing. On that basis they might proceed anyway, I honestly don''t know. Good luck!

Sorry to hear about your situation.

Please don''t discount the possibility that documents will be produced the night before or even at court on the day. That''s what my x always did with me. That way you don''t have time to prepare anything and it just adds to your stress.

But then some people are like that.
