My sol says no point in applyin for legal aid but i only earned 13k last year and my mortgage payments alone are more than that what should i do ?

You have dependent children don't you?

They use a formula to work out how much they allow to care for the children etc, so I would say that you are likely to be entitled to some legal aid if not full legal aid.

My solicitor said that my ex-husband may have even been eligable owing to the money he was paying me and he earns over £24,000 minimum.

Certainly worth chasing up.

A lot of people can get some legal assistance, where they pay a proportion of their costs owing to their salary.

You might be ineligible on a capital basis: you need less than £8k assets in your sole name. That doesn't include your house where you can have up to £200k equity.
