Has anyone encountered this with Legal Aid?

I do not quality for Legal Help as my earnings are above limit. As such, my solicitor was not obliged to fully explain legal help/legal aid.

My SX2B is self employed and has been told by his solicitor to apply for full Legal Aid - before even a divorce petition has been filed. My solicitor says that she is baffled on this, as he doesnt need full Legal Aid to get things started? Is this correct?

Tonight I have asked SX2B if he has yet sent in the forms to apply for legal aid and he has told me that his solicitors are waiting for me to supply them with my wage slips for him to apply. I was quite taken aback and told him that his legal aid has nothing whatsoever to do with me, he applies on his own merit and my wages are not taken into consideration. SX2B was adamant that the lack of my wage slips are stopping his solicitors from applying for legal aid for him.
Can this be the case???

Hi, well from my experience with Legal Assistance, like you say you are nothing to do with his claim. If you were not getting a divorce he would not need to apply for Legal Assistance. Also, his solicitor would not be applying for full Legal Assistance until it was necessary. I have had lots of extras added on to my Legal Assistance Certificate as matters have arisen.

You could try contacting the Legal Services Commission to clarify things but I think I am correct in what I am saying.
