Can anyone advise what my partner can do about his ex to be taking his children out of the country without telling him?

Is this for a holiday and does she have a residence order?

yes a holiday which she took them away last week without telling him. Also he went to the house and she has changed the locks on the house which he owns and pays the mortgage for.

Is there a residence order in her favour, a shared residence order or a contact order?

Not sure but his solicitor has said he has full parental rights.

Why does he want to do anything about them being taken on holiday?

In a nutshell it is a matter of courtesy for parents to inform the other parents when they are taking holidays and reorganise contact. However, there is no statute law to prevent either parent taking children abroad for up to a month when it is a reasonable thing to do. Going on holiday once or twice a year isn't unreasonable.

It works both ways, unless there is a residence order in favour of the mother your partner can book a holiday and take the children abroad in his time too. Even when there is an order for contact it is usual for there to be arrangements for holidays. Annoying though it is surely the main thing is the children will have a good holiday.
