Hello,
Please I need an advice about this issue. A married woman got a child for me. She claimed that she is no more with her married husband (living outside UK) but they are still legally married.
Since she is still in marriage and not divorce, is she eligible to claim a child maintenance from me? She does not agree with family based arrangement.
Any advice will be appreciated.

John.

Hello Timothyjohn

As WYSPECIAL has mentioned if you are the biological father of the child, then you would have the responsibility to pay child maintenance.

The Child Maintenance Service can assume parentage if the person named as the parent:

* Was married to the child’s mother at any time between the conception and birth of the child (unless the child was adopted)
* Is named on the child’s birth certificate (unless the child was adopted)
* Has taken a DNA test that shows they are the parent
* Has legally adopted the child
* Is named in a court order as the parent when the child was born to a surrogate mother

If parentage is assumed, they will work out a child maintenance amount. The person named as the parent has to pay this until they can prove that they are not the parent.

For more information on the different ways to set up child maintenance and for a more personalised service, you can visit the Child Maintenance Options website at www.cmoptions.org

The DWP have a sorting out separation web-app that you may find useful. It offers help and support to separating and separated families. The link is: www.wikivorce.com/divorce/Sorting-Out-Separation.html

Regards

William
