Hi all.
my wife and I are separating, we jointly own the house which is worth about 150k, we owe 50k, I can raise another 50k to buy her out, which I would like to do, however she has been looking at a house with her parents which is 130k, so basically I dont know what she is up to or where she will get the money from, we have 2 kids 5 and 2, she is not in regular employment, i guess my basic question is, I know what child maintenance I will have to pay to her, but would there be any other, ie spouse maintenance? if this is so I will not be able to buy her out. She apears happy to walk away with 50k and set up the child maintenance, but I suspect it may not be as simple as this. Does anyone have any info of how this would work? I can go ahead and arrange this mortgage but if I have to pay extra I will be stuffed.

Hi,

It is hard to give a calculated comment purely on what you have said.

Are there any other assets or debts? Do you have a pension fund? How long have you been married etc.

Starting point is 50/50 split of all assets including pension (although this may not be 50% of CETV).

The £50k that you are suggesting is purely 50% split of equity. With children so young you may well be looking at an amount of spousal maintenance too.

Have you thought about attending mediation and putting each of your financial positions on the table?

Your ex will also be in receipt of certain benefits too, so these may amount to a certain amount and she may therefore be able to raise a small mortgage.
