paperwork for house in France

Hi there,

Just a quick one , I'm divorced ( very happy too ) we divorced over a year and a half ago and I hadn't heard anything so just asumed all was done ...then out of the blue paperwork from ex's solicitors arrived to say you have seven days to signed paperwork for property in France or legal action will be taken ....my question is this I don't have a solicitor anymore ...His solicitor wants me to get this paperwork signed by a Notary ..can I charge his solicitors for this inconvenience and cost ....I believe this should have been done a long time ago

If the property is to be transferred as part or an order then you will need to complete the paperwork. If the paperwork needs to be notorised now then it will most likely have needed to be notorised when the order was first made so the delay has no bearing on the request.

As far as the cost goes, if a notary is required to transfer the property to comply with the order, you will have to bear the charge in order to comply.

If you are strapped for cash you could respond by saying you will transfer the property but you have difficulties with the timescale proposed as this leaves you in financial difficulties but if they are to bear the charge this would hurry the matter along.
