Data Protection SAR Request - Legal exemption?

Hi All,

Can I make a Data Protection Subject Access Request to the solicitors who handled the conveyancing of the FMH? Would they be able to claim Legal professional privilege as some sort of exemption? I would like the information as I am considering complaining to the SRA about the firm. I''ve read the ICO page on exemptions and am not really any clearer about whether they could claim an exemption...

Were you a client of the firm?
I would have thought you would have the right to see your file unless doing so would compromise another clients confidentiality.
Have you formally complained to the firm yet?

If you were a client of the firm a SAR can be easily fulfilled by providing a copy of your file and possible a ledger printout which will show details held on a computer system (which should appear on the physical file in any event).

Is there a purpose for the request?

Thanks both. I was a client in that they were engaged to do conveyancing. I have a formal complaint in play with them at the moment. Essentially I believe they allowed a conflict of interest (my ex works for them) to unduly influence their actions, so unless there is a full hands-up apology out of their complaint process I will be going on to the SRA / Ombudsman. I would like the SAR to see emails - to see if there is any evidence of internal discussion of the conflict of interest. Though whether they would be silly enough to put such things in emails, and if so to then disclose such emails to me is questionable.

So what actions did they undertake that you think we''re against your best interest and what loss did you suffer as a result?

Sorry for the slow reply Bubblegum11. They ignored joint instructions and a court order regarding distributing proceeds of sale, and as a result I could not pay off credit card debts which incurred interest and fines.
