Hi,
I have proposed a settlement to my ex for £60k payment from the sale of the property which is what she has asked for from day one. I have also agreed to clear all marital debts from whatever is left and continue to pay the full amount of child maintenance each month. I have also offered to cover the cost of all remedial work required on the property so it is ready to go on the market once the building certificate is issued. This will be around £5k. I have also agreed to pay for the estate agents and solicitors fees to sell the house. I will then have whatever is left which will be around £25k.

In terms of pension sharing, she wanted a sharing in her favour of 50% of my existing pot. As 5 years were pre marriage, I have gone back with a counter proposal of 40% of my CETV less 40% of her CETV which roughly gives her £40k to invest into her pension plan.

I have now received a letter stating that the offer is declined as it does not meet the original agreement. She is now starting divorce proceedings and has taken an Ice Berg loan to pay for all her legal costs and this will also cover the costs of court etc. As such, they will be making an application to the courts for this to be cleared from the equity. As I understand, the maximum amount of this loan is £5k and she has already used £2700 of this. Can the courts agree to her legal costs coming out of the equity aswell given that I cannot afford legal support due to debt? I owe my parents £10k for debts they cleared for us back in March. Basically, I would be left with £10k

This all just seems so wrong. She is hanging onto every word her solicitor is saying and we have had a deal on the table 3 times now that she has accepted, then changed her mind. Would the courts consider all events that have taken place over the last few months in making a decision? I can demonstrate that I had a mortgage offer to give her £60k, she agreed and then changed her mind. I lost the mortgage and then she said she would accept £60k. I wasn''t able to get another mortgage because of debt and agreed to sell the house. She wanted £60k from the sale and now has declined that.
