Is it OK to change solicitors mid way through divorce.
My case hasn''t been a happy experience [is anyone''s] extremely stressful and poor outcome, we are now moving onto financial resolution and being as I''ve been so unhappy this far would it make sense to change?

Hi worriedwitless ,

When you say your case has had poor outcome what do you mean ? its only because i was going to change solicitors mid way through and decided not too. one of the other Wiki''s on this site suggested that i complain to my solicitor about the poor outcome. I have and its not much better to be truthful... very stressful as i would like to move on.

Basically, poor outcome as in we are losing at every hearing. Mostly this is down to the other side having a very artful Barrister who bangs on ad nauseum to hammer her point across, my side on the other hand seem to prefer the very brief and pretty pointless questioning. There have been issues around paper work I submitted to solicitor not being received by the Barrister, statements and reports not being sent to me, only having sight of them on the day and of course different barristers every time we have a hearing, would appear to be down to last minute booking. Barristers who are clearly not familiar with the case and seem to be just turning up.
I''m already with the firms senior partner and she knows how traumatised I''ve been and my total loss of faith in the justice system, she knows I''m not happy but maybe it doesn''t much matter, maybe it''s win some/lose some in the legal professional.

You need to be confident and happy with your legal advice - I learnt the hard way and my first legal team let me down - I am pursuing a negligence case against them.
I changed solicitors and was confident they were dealing with my case in my best interests - totally different from the first rubbish lot.
If you''re not happy then change but bear in mind you need to pay your bill before they will release your files. It could delay proceedings - maybe depends where you are with your case?
Just use a barrister - some people do - it can be expensive but also could save money on a solicitor.
Do the best thing which is right for you - you only get one chance - make sure you get the best advice you can. Good Luck.

How do you know who is good though?
In the absence of any recommendations the only option I had was the free half hour and make a choice but in all honesty they all sound amazing until you start.

I changed on a recommendation - but there is a list of good solicitors - the one I changed to didn''t live any where near me but everything was dealt with by email and phone, I visited them a couple of times. Obviously as with anything you only get what you pay for - the one I started with was cheap and local - the professionals I ended up with weren''t local - and weren''t cheap - but the outcome was good. Better than I could have hoped for. It is difficult do a lot of research. And ask around. You need to be confident you are getting the best representation you can.
