I suspected you were working on a figure of £100k in which case your spouse received 84% of the assets rather than 74%.

Your solicitor cannot second-guess your spouse''s solicitor''s strategy but there was a good chance that the argument to cap your share of the matrimonial pot would have been deployed at some stage.

You don''t say at what stage the matter was settled. Did you go to final hearing or did the judge make a recommendation at the FDR hearing which was consent to by both parties?

Sorry was 16/84...yes the final hearing was the first I heard of the 16k limit...although I was aware myself that saving must not go over 16k whilst on benefits....I just wasent aware that your entitlement when the Gods are splitting the assets would consider the 16k limit....should have done my homework I guess

On a final note thankyou all for your comments....5yrs ago when this all started if I know then that 16k would be all I was going to get then I could have gone straight to court and saved £3500 costs...btw x-wifes costs where £8500 for some reason....if my solicitor had advised me then I wouldn''t be here now....lol
