Solicitor or Barrister for Final Proof

Can anyone please shed any light on whether it is better to have a Solicitor or Barrister represent you at the Fianl Divorce Proof.

My partner has been going through a messy and bitter divorce (from his stbx)for over 31/2 years.

The final proof is set for next month (if not put off for the 4th time).

After looking at various topics on the fourm I was wondering if anyone could inform/advise me if it is better to have a Solicitor or Barrister represent you at the Final Proof.

Also we live in Scotland so dont know if you have the choice or if it is only in England you get the choice.

Would be grateful for any input.

Hi, the barrister i always used put it to me quite simply,
the solicitor is like your secretary, replying to questions and helping you answer them in the right phrases.
a barrister deals with the courts.
i have always used a barrister for all my hearings as they are in court every day covering the same issues, the experience they have in court is more than any solicitor will have.
if you add up the cost it is also cheaper to use a barrister as they charge a fixed rate for the day, if you work it out 6 hours of your solicitors time costs a lot more than the barristers charge.

Hi Dawn

Many thanks for the reply.

The next problem is we live in Scotland and I have just found out they call them Advocates and not Barristers.

I have tried searching for information and it seems to be that they mostly deal in the High Courts.

Can anyone suggest any Advocates who practice in the Glasgow/Dumbartonshire area who deal with family Law/Divorce cases.

Hi, you can usually only get one by going via the solicitors.
