Help me please.

I am currently going through a divorce after being with my partner since 1988. we both earn the same salaries and she has a better pension. we have two children 12 and 8 and aprox 120k equity in the house. her solicitor has offered me a 62-38 split and she keeps the house and all the contents... is this fair?

please help

hi, you havent said if the children live with you or her, if they live with her are you paying any maintenance and has her sol only offered you that amount as that is all she can afford to get on a mortgage?
if she could afford more on the mortgage then you have to take a view on whether it is worth going through all the hassle with the courts and the costs involved.
you would get another £14400 if the judge awarded a 50/50 split but your sol fees could be as much as that.
from a personnal point of view i would try to negotiate with them to get a better split, if they do not budge i would accept it and save myself the hassle of going to court.

Hi Dawn,

thank you for your reply.

my ex to be will have residence of the two children however i have said i can have them two or three nights a week over at my home as and when i get one.

she is on 30k + a year(As am I) she has a good pension which is est CETV £48K and she is finacially sound.(No Cards etc.) where as i have a loan for a car of £8k over 5 years.

Mantainance has been agreed as i have said that i wouldn't see the children go without even if it was extra money she needed.

the problem i have is that i am prepared to walk away and leave her the full house and contents and only require the extra money to furnish a home for my children. ie beds sofa table etc.

we currentlt have two endowments running which mature in 2013 and worth £50k when matured. to cash in now around £30k. again we have sort of agreed to continue with these and split it 50-50 on maturity.

Hi Mally,
It seems to me to be a reasonable figure compaired to what my STBX is doing to me. Dependant on your own CETV it could be used to bargain more if there is a large difference so that you can have more capital to create an environment for you and the kids of your own.
If you can come to an agreement between yourself and Ex it's better thatn going through sol / courts
