Myex2b owns both the car i use and thecar he uses. They werebeing paid from our joint account. We now have separate accounts he has made no payments on the car i use and is insisting i pay the remaining nearly 1k. After payment he says he will give me the logbook etc so i can insure it. He still wants the car put in pot.He has sold the car he uses as he says he couldnt afford the payments without consulting me first. If he has gained financially from this am i entitled to half ?
Seein sol on monday about it so would like to no my options.
Thanx

Gorgeous,
Assuming both cars were purchased during the marriage, and you were married for more than a short period of time (greater than 2 years or so), then ALL assets are in the pot, whether on not he likes it. So his disposal proceeds from his car are also part of the pot.

Slightly different question on the same subject:

I own 2 cars, one owned before marriage, the other bought more recently and mainly used by stbx. Both are insured by me with stbx as a named driver.

At separation i tried to give car to stbx, but she refused because did not want to pay own insurance. Took it anyway and is using it on my insurance policy still.

I dont want this liability on my insurance any more, what can I do. stbx needs the car for when our child is with her or he will be disadvantaged.

Braindearth,
Put it in writing to her that as of XX/XX/XX, the car will no longer be insured by you and it is her responsibility from there on. GIve her sufficient time to arrange insurance. Perhaps 2 or 3 weeks. Also Transfer the vehicle registration to her at her new address if appropriate.

She has to step up to the mark at some point.

gorgeous - you can insure a car that isn't registered in your name. My x2b's car was registered in my name but insured in hers.
