Hi

I’ve submitted my form E to the court by the date I was supposed to, I’m due to send off my statement and my chronology. I’m a bit nervous now as my ex husband has been ignoring me and I was unable to exchange form E with him, as he isn’t communicating should I have sent him form E anyway by post? And should I send him my statement and chronology as well? I did say in my email to the court that I haven’t been able to exchange this but would they look at it badly that I didn’t post it to him?

Have you written to enquire about arranging the exchange?? That would be the first step. You can say you have filed your Form E with the court.

If do do not get a Form E that will be top of the list in the statement of issues.

Are you sure he is aware of the hearing??

I think he is aware, I’ve text him, WhatsApp him, emailed him and asked his brothers wife to ask him when we are exchanging and nothing.

You may need to provide the proof of attempts to exchange to the court. Presumably he is not represented by a solicitor??

The court will likely give him a second chance to provide full financial disclosure. If he does not and persistently fails to eengage, sanctions may be applied, including potentially prison. It is also possible for the matter to proceed without his input.
