Dear all,
I obtained Decree Nisi through a solicitor well over 2 years ago now. I want to file for Decree Absolute without financial arrangement.

I want to find out if I can carry this out myself without paying yet more money to a solicitor.

My ex is in agreement and we have sold the family home and have no other assets, our children are adults i.e. not dependents.

I know I need a D36 form but has anyone carried this out and can advise what I need to do or advise on the process.

It is pretty straightforward to get a simple Clean Break Consent Order if there is nothing left to divide. I assume there are no pensions to consider?

There is nothing to stop you getting the Decree Absolute without a legally binding financial settlement but you do need to be aware that financial claims remain open.

You need to send a brief covering letter/statement with the application. This should explain the delay (sorting out finances), and confirm that a: you have not lived together as a married couple since Decree Nisi and b: no (further) children have been born of the marriage.
