back in 2017 ex was ordered to pay me a lump sum, if payment was not received the house was to be sold, this never happened after years of failed promises of a re-mortgage and back and forward to court,

he voluntarily agreed to place the house on the market by end of August, I was to agree a price and we were to have joint conduct of sale, no communication has been made since then, so lodged another d11 with the court,

remote hearing tomorrow on sending my position statement to his solicitor, I was informed by her he had a new solicitor and that she would forward it on......I was then sent a letter via email saying they are going to apply for an adjournment based on the fact that the house has been difficult to market because of covid,

and that he was looking into equity release but a surveyor could not attend the property because of covid...at the end of my tether now really 3.3 years of waiting .....what would you advise? can a judge really adjourn? properties can be marketed at mo!!!

If the judge has the appropriate facts in front of them they may be happy to go ahead.
The problem is whether a bundle has been prepared and provided. This shoukd contaon all relevant statements and documentary evidence.
Tbh though it sounds like a pretty straightforward enforcement. He has breached the order and needs to either sell or buy you out ASAP.

thanks! I did a position statement they are basically saying due to covid they have difficulties marketing the house, and were thinking of equity release which would involve a conveyancer to come out to the property...there is no reason as to why they could not market it at all! just another delay tactic after 3+ years......thanks for response i hope he does not adjourn this
