can anyone tell me why the W solicitor has asked if H will be runnung a conduct case?

Financial settlement on divorce is about needs first. Conduct is rarely taken into account unless it has resulted in serious financial consequences and cannot be disregarded. This may be e.g. If an injury has been inflicted that prevents one of the parties from working or perhaps someone gambling away the marital assets.

If you have completed the conduct box to highlight some sort of bad financial behaviour, it is reasonable for the solicitor to ask if this will be a conduct (as opposed to pure needs) case. It may be wise to say that this is first and foremost a needs case but that those needs should be seen in the context of the conduct you have mentioned.
