Will i still be able to request a Clean Break order in October if the family home is not going to be sold until our child reaches 18/19.

You need to post more details for someone to comment.

You can't just look at the house in isolation.

Is your ex likely to agree?

Our only asset is the family home, mortgage free.
STBX knows/agrees that I will be asking to stay in it until our child finishes full time education.
I care for my disabled mother,so I am unemployed.
STBX is retired and claims his state pension.

If my understanding of a clean break order is that neither of us will make any future claims for maintenance, lottery wins, inheritance etc..we both agree on this.

So that just leaves the house being sold when our child reaches 18/19 or on certain trigger points.

Can we have a clean break order even if the family home is still owned jointly at whatever % we agree on ?
