Hi I have my FDR 29th March and my stbx will not send me any responses to my questionaire or produce his financial disclosure. The only contact details I have are his email address but when I attempt to send an email its returned unable to send so I am assuming that he has blocked my emails! I have his number but will not return my calls or texts! There is a penal notice on him that the courts issued, do I ask for an adjournment or still turn up on the 29th? I dont want to turn up knowing the FDR cannot go ahead and face costs for wasting court time? Any ideas anyone please?

I don''t think there''s much point asking for an adjournment - what''s to say he will get the responses to you by the new date?

You will not be wasting court time, he is doing that himself. If you have complied with all the court orders you cannot be penalised for his non-compliance.

The judge will not be impressed by his behaviour if he does not produce his disclosure. It may be (hopefully) that the court will act on the penal notice.

Thank you Lunar, apparently he has sent some paperwork to the courts and when I asked for copies they said I was to enforce the penal notice. The courts issued the penal notice so do you know if I should just ask the courts to enforce it or do i have to pay to have it enforced? I am really stuck on this one as I am self repping and do not have the finance to pay for enforcement? x
