:unsure:hello can anyone help. i am now on my own, hes left.. i live in a fairly large house with all 3 kids but only 1 is under 16, the elders have no intention in leaving anytime soon, can he make me sell and move into something smaller..

First question. Is the house in his name alone or joint
names ?

If it's in his name alone you need to take action p.d.q. to prevent him selling. If this is the case I will explain, if you so ask, what this is and why you need to do it.

Second : if you carry on living in the house can you afford it, with the aid of such income as you have, child benefits + child support + tax credits if applicable and spousal maintenance if applicable ?

It is possible that a sale of the house could be deferred till your youngest child is 18.

It is not at all easy to advise without knowing more. A
court can order a sale, to be sure, but in this case I think it's perhaps unlikely while there are dependent children, but nothing is set in stone.

If you can tell me more about your ages, length of marriage, ages of children, respective incomes, capital assets, pensions, I may be able to give you a better idea.
