Hi,

So have an offer on FMH, Negative equity situation and ex has been ordered to cover this cost in the Consent Order and have my name removed from the loan. So far he has not done this. Our convayencing sol has said she wants him to deposit monies in their account and they will not forward contracts etc until he has done it. And that she will make sure we are not made homeless.

So ex has posted me contracts for the sale and is threatening me to sign them immediately the trouble here is I have been unable to find another home for me and my children and have been looking since the offer was made without any luck. Also these contracts don't appear to have been issued by the solicitor and seem very suspect. Of course I am having trouble contacting the Solicitor again.

So can he force me to sign and make me and the children homeless or can a judge force me to sign making us homeless. I am so worried about this as we have been in limbo for the last 18 months due to non payment of the court order. So SO stressed.

Any advice

Don't do anything that isn't approved by your solicitor. They are there to act for you so your X can't go behind their backs and ask you to sign without their approval. It probably wouldn't be accepted anyway by the purchasers if it doesn't go through solicitors.

As to your housing situation, it depends entirely on the precise wording of the order. Whatever it says, goes: it can't (usually) be changed once the order is made.

I will find the original court order and write exactly how it was worded then maybe you can give me a clearer Idea of my rights. Nothing like being put under pressure again. oh well
