We are about to go the court to finalise out finances as my x wanted everything.

She is hoping to stay in the family home, and take it on herself, but she lives of the benifits system and works 15hrs per week.

I am hoping for a Clean Break so that I can start again and get another mortgage as the current family home is in joint names.

What makes matters worse is she spends 4-5 nights per week in the home with her boyfriend.

Iam just amuzed that she can stay there and use the state to pay the mortgage, will the last forever??

Any advise would be good, but also such I be asking for the house to be sold as there is over £100K equity.??

So here goes:

her 41

5 -9

I have them 3 nights per wk

Income

Me £37k
Her £4k

House

Value £220k
Mortgage £91K

Married 10yrs

Savings:

Me (Endowments) £27K
Her None

I hope this is enough, i feel so frustrated as she is living in a lap of luxury, iam am totaly broke through having to move out, solicitor fees etc.

She has had the whole house & Garden redone.

And she is claiming single mother beneifits and does not pay council tax and get working tax credit, her boyfriend stays up to 5 nights a week.
