Mediation not working out - what next

My partner has been separated from ex for over 4 years - 2 children 21 and 17. They live with their mother in family home. The decri Nisi come through about 8 months ago. His stbx does anything she can to avoid going to mediation meetings the last one was in November and she has failed to complete the paperwork or put house on market. My partner has tried to talk to her but gets nowhere. She was the one who had affairs and wanted the separation she continually lies. The mediator has written to her again third time! If no response they will complete form to say mediation has failed.

Can my partner take he to court himself or should he go through a solicitor. He really wants things to move quickly as he is at his wits end and just wants to move on. whats the best plan of action.

If she wont attend mediation then your partner can apply to court for a decision. He can self rep and doesnt need to go through a solicitor.

Worth thinking about when the 17 year old leaves education as this will reduce any CM liability to £0 and you could end up spending months arguing about CM which will just end soon anyway.
The threat of Court may prompt the ex to start talking as it''s just a painful and drawn out process which can also cost a lot of money. Most couples seem to agree out of Court anyway but the threat of going through the Court process can either prompt discussion or make the other side dig their heels further in.
