mediation is not exactly voluntary; it depends on the type of application - and you don''t specify - but the law states clearly and simply, ''Before making a relevant family application, a person must attend a family mediation information and assessment meeting''.

Obviously if you refuse mediation you will end up in court, which will be far more unpleasant, drawn out and expensive. A solution will be imposed on you by the court, which is likely to be less favourable to you than one you agree between yourselves.

If it is not satisfied that mediation has been attempted the court can send you back to mediation, and can also refer you to further mediation at any time during proceedings.
