My X and I have concluded mediation and an open financial statement has been prepared together with a (without prejudice) Memorandum of Understanding.

The mediator said at the outset that these documents should be checked out by our respective solicitors and if ok, a Consent Order can be drawn up.

Who would draw up the consent order - my solicitor or his, do we just decide between ourselves which solictor? We can't use one of the cheaper online methods as ours is too complicated.

Another suggestion by the mediator is to investigate the possibility of requesting that the District Judge simply drafts the order on the strength of the concise summary at the end of the Memorandum of Understanding.

Does anyone know if this is possible? We would still have to have the documents legally checked first but this would save the extra cost in getting the solicitor(s) to draw up the consent order if the judge can do it instead.

Hi,

I have just been to the first mediation session and was told that either solicitor can do it, but it ought to be a solicitor, and that we can decide between us when we get to that stage.
