Hello

I am new here and hoping someone can help clarify something for me. I have a global order in place for 6 years, my ex husband claimed to be earning a lot less money at that time and it seemed the judge had limited options. My ex has now returned to earning a six figure salary, 5 times more than he was claiming to earn back then.

I do not have a Clean Break but from everything I have read it seems that a variation order is expensive and not always successful. I don't have the funds or the mental energy to go back to court. I have done a CMS calculation and the monthly total is higher than the amount of the global order, but what happen to the spousal maintenance aspect in this case?

If you have a CM assessment you get that amount.
A global order is used to ensure a maintenance level regardless of CM, usually where income is opaque.
If it is clear that you will be better off with CMS you can ask for an assessment. I think the order stays in place in case the income drops.

What is the term of the order??

Thank you for replying. I was just a bit confused as CMS is only for child support but the Global Order covers spousal maintenance too, so does that element just go?

The term is until the children are out of terrestrial education or ends if I marry again.

Do you mean university education??

If you do, I imagine the order remains in place even after statutory CM ceases. The amount paid would reduce to the amount stated in the order.
