It has been suggested in mediation that we include a nominal maintenance order in our financial Consent Order. My understanding having researched this online is that the receiving party may only request an increase in spousal maintenance in extreme circumstances such significant loss of earnings, a disability/ illness or significant increase in earnings of paying party.

Q - as the paying party myself, are there any other circumstances that I should be aware of?

Spousal maintenance is based upon need and ability to pay.

Even if some huge win or windfall left you able to pay they would still need to demonstrate that there had been a change so there was a need.

As your research shows it is extremely rare a nominal order is ever changed.

Having it in place may affect things like mortgage applications as it is an additional risk so may make you a less attractive customer.
