My DH who who is asking for the divorce & has filed, is planning on leaving the family home, and has stated he'll pay the mortgage/all house bills (council tax/car/water/gas/elec etc for the next 6 mths whilst we come to a financial agreement. He is not going to pay the monthly amount he gave me for house keeping as he'll need that for a deposit on his new flat. I was under the impression (rightly or wrongly) when he moved out (better for all concerned) that he had to keep paying all the bills he paid previously including the housekeeping.
Anyone know ? I work too & there are two children under 13 in the house. My solicitor says its in lieu of maintenance. Just wanted to check before I even agree. He's on 3 times what I am!

Hi

The only statutory requirement is for him to pay child maintenance which is based on his income. www.gov.uk/calculate-your-child-maintenance

You could check this and see how the figure compares with what he is proposing to pay.

If it is greater, you should ask him to pay statutory CM.

If he is paying the bills, is your income sufficient to cover other costs?

Thanks Hadenoughnow. In that case I will leave it as is, & take that over the maintenance as that is more. Just wanted to check I'm on the right track. Gives me chance to get sorted.
