hi

my stbx will receive enough capital to rehome for her and our daughter (she will have primary care) needs.

However re income, she currently has no job (since Late 2017) and is potentially planning to return to study to re-train. My solicitor is advising her form E needs can be met by:
1. child maintenance as calculated by the CMS calculator
2. Various benefits
3. Balance would be covered by spousal maintenance (for a defined period)

In reality I could most probably afford to pay more spousal (but would prefer not to) so would the benefits not be affected by what I would pay her anyway. I am nervous she will push back on getting benefits and want to get it ALL from me ?

Since the introduction of Universal Credit spousal maintenance is for people who are too wealthy to get any form of benefits.

As in it's treated as unearned income unlike child maintenance so if your ex is getting the child tax credit of say £300 per month if you paid her £301 in spousal maintenance she would get exactly £1 extra per month even though it's cost you an additional £301.

If she is a student with a student loan, she may not get UC.
