New Partner's assets

My wife and I split 15 months ago, and I'm now with a new partner though not divorced yet. My new partner has some rasonable assets, and my former marital home has been sold and the cash and contents split. I'm paying a decent amount to my ex, but she seems to think she has a claim against my new partner's assets as well. Does anyone know if this is right or not?

Also, I'm just buying into a new business - will kmy ex have any increased claim on me because of that?

hi,

i am no legal expert!!! As i understand your partners assets will not be at risk, however you may be asked to pay more due to fact that your expenses are shared with someone, therefore you have more at the end of each month.

As i understand, if you are not yet divorced your wife may have access to some of the money you make from your business, however if you can prove that your business came about from what i understand as "personal endeavour", ie your wife had nothing to do with it, and it came about as a result of your hard work and cannot be associated to the marriage, you may have a clause. You'll need legal advise on this one as i must re-itterate that i am no legal proffesional.

Hi Cash,

You say you have sold the FMH and proceeds and contents split. Was this agreement put into a Consent Order? Are there any other assets of the marriage?

When you say you are paying your x2b a decent amount, is this CM or SM or both and how was this figure reached.

Do you have children and if so, how many?

Does your x2b work, if so how many hours?

Your new partner's assets are only taken into account as much as your needs being less as you have shared accomodation, bills etc.

Does your new partner have children living with you?

I guess unless you have a consent order detailing the split of assets then if you used your share of the proceeds from the sale of the house to finance the business then your x2b may have a claim on it. Also, if you were to have an increased net income at the end of the month then she could also asked for this to be taken into account.

It would be good if you could also give details of the length of marriage, children, other assets etc.
