We've agreed to submit separate D81s as my EXH wouldn't agree to my D81.
However, there's very important information that my solicitor wrote in the
Consent Order, which my EXH knows is correct but, he doesn't want the Judge to see and is demanding it is removed.
This information is to legally protect and indemnify me from something he knows he has done. As he will not agree to this information and sign this document, he's trying to enforce I sign the document with all this information removed.
Essentially, as it's a
Clean Break, I wouldn't have any recourse etc., in the future from what he did. I cannot say but it is serious.
Furthermore, my solicitor has emphasised I cannot sign the document he wants to submit to Court.
He is now threatening to issue an application to show cause if I do not send him my signed D81 and the signed Consent Order he wants to submit to court.
My solicitor sent my D81 and the Consent Order with the necessary sections included that will protect me. Unsurprisingly, my EXH will not sign this and has again said, he will not sign, he will not indemnify and essentially this can only end when I capitulate to the Consent Order he wants to submit to court.
We're going around in circles, which incurs further legal fees. He will not sign, he is again threatening an application to show cause and claiming costs.
What can I do here, can anyone shed any light - I am simply trying to achieve a clean break which protects me in the future. Thank you.
