Hi everyone, after a bit of advice.

My wife and I have drifted apart, totally lost our spark and both agree we should divorce. We have 2 young children 5 and 2, we own and have a mortgage. I work she looks after the youngest full time and has no income.

We both agree for the kids sake her and the kids should stay in the family home and I should move out.

There is no way even with family help she would be able to buy me out and I don’t have anywhere near enough deposit to buy my own place. I have nearly 100K sat in the house (she has the same)

I don’t have the option of living with family and I really really don’t want to rent. I so badly would like to access at least some of my 100k so I can buy my own place.

Is there any way (disregarding selling the house and being brought out) that I can make this happen? Any loophole to exploit?

Thanks!

If she isn’t working even if she can afford to pay the mortgage with her income from maintenance and benefits you are going to have to remain named on the mortgage.

Unless you are a very high earner that will almost certainly prevent you getting another mortgage.

You say you have £100k in the house and she has the same? Are you assuming a 50/59 split? Again that is highly unlikely to happen.
