I am about to pay my ex a PSO settlement. In the calculation of the PSO can her future pensions earnings be taken into account, she will work for 4 years beyond my retirement date giving her the opportunity to increase her own pension pot by £90k I would like to reduce my PSO by some if not all of this amount, is this possible ?

I am not sure what your circumstances are, can you tell us if the PSO is part of a sealed consent/court order and if so has the PSO annex been sent to the pension provider?

Hello, I received an actuarial Pension report yesterday, it is to be used as an input at an FDR hearing in the next month or so.

I am expecting a PSO to be made against my pension of £140k as its the only sensible option

To balance our respective pension pots I need to give away £140k

I would like to try and negotiate using my ex future earnings

If you have just received the actuaries report and awaiting FDR you are still able to negotiate.

Does the report not include calculations for different scenarios and information about your ex''s pension provision?

It is usual when appointing an actuary for both sides to submit questions they wish addressing.

If you wish to retain a greater percentage of your pension you can offset against other assets but be aware it is not calculated pound for pound. It would be very difficult to negotiate against earned income your ex may receive in the future as illness/redundancy would affect the amount.

Do you know where I can look to see if future earnings and future pension contributions have been taken into consideration when negotiating a settlement, a nice precedent would be ideal !!
