i have been served divorce papers from my ex husband but the name he is divorcing me in is totally different from the name he used when we married, is this legal

Hi lynukk,

Welcome to wiki, I am sorry you find yourself here but you will find members very supportive.

Your question is not one I have come across before but, using logic, your ex/stbx must have provided the court with legal documents giving proof of change of name, as a copy of the marriage certificate must be attached to the divorce petition.

If you are in doubt, you could request a copy.

thanks for the reply, im not sure if the name change was legal as he still uses his birth name as well and the name he put on divorce papers was his brothers name..as you may conclude he is a bit of a crook im afraid soo willlook into it further..thanks once again

I divorced in a different name to that from my marriage, I had changed my name by Deed Poll after separation.

I supplied a copy of that Deed Poll to the court with the divorce application, to support the fact that the applicant''s name didn''t match the marriage certificate.

I was surprised to find that the Court didn''t photocopy that document and attach it to the copy Petition they then sent out to my Ex. He promptly tried to stall proceedings on the basis of "not recognising the name on the document", which seriously annoyed me as I had told him before then.

You could call the court and ask whether they were provided with any evidence of the change of name, they may send you a copy in exchange for payment of a fee.
