Hello,
I am applicant in my divorce and it seems now unlikely that we will be able to negotiate a financial settlement before before the 12 months to apply for final order are up. I know the court will ask for a statement, however, a child was born to the marriage after conditional order was made. Is this likely to cause issues? We have not reconciled and are living apart. Should I apply for final order before the 12 months expire?

A child being born will be likely to have an impact on the financial settlement. Presumably though they were conceived before the divorce process started if there has been no reconciliation.

The divorce process is separate to the financial application so you can finish the divorce before agreeing the finances if you wish.

Thank you for the reply. The child was conceived after a brief (unsuccessful) attempt at reconciliation after initial application but before conditional order. We both now live at different addresses. Do we need to make the court aware of the new child or is it enough for them to be mentioned in the financial settlement?
