You need to make all reasonable attempts (write formally to family, known friends and former employers, notices in newspapers, instruct an inquiry agent) to trace the Respondent. If the Respondent can''t be traced you can then use the letters, notices, reports as documentary evidence and ask the court to dispense with service of the papers and grant divorce.

When the Respondent can be traced but doesn''t acknowledge service you would need to pay the court bailiff to serve the papers and provide evidence they were served correctly in a statement. The statement can then be used as evidence so the court can grant divorce.

Hi,
I have the same problem, but my divorce papers were served to his parents address which is my next door neighbour!
I was a victim of domestic violence and there is a Non Molestation order in place which prohibits him and his family communicating with me directly.

I''m pretty sure his parents will have given him the papers and he has chosen to ignore them. My problem is I want to move on and away from his parents, I bought the house before I met him and he conned me into putting him on the mortgage and deeds, then set about running up debt against the property.

I can''t sell the place without his signature, I''m on a low income and the stress is really destroying me, I don''t know what I can do next, I''ve tried asking friends his whereabouts but none are willing to give me an address they say they don''t know where he is other than he''s living with his girlfriend.
Any help or advice would be gratefully received.

Many thanks
