Dose this make sense in the order ?

Transfer of property
11. The respondent shall simultaneously with the payment of the lump sum transfer to the
applicant all her legal estate and beneficial interest in the family home. The applicant will instruct solicitors for the transfer and provide the respondent with the transfer documents for execution in a timely manner. The applicant will pay all the costs of the transfer of the property, to include any incurred by the respondent in respect of the transfer.

so have to remortgage to pay her off
have solicitor to do the mortgage so it goes through them
now I think the land registry has to be signed before the bank transfer the money…..so timely manner won’t work

happy to pay for the solicitor but what cost the other party incurred???
I got done over before on the divorce application so not looking to be done again.

I think in practice all this happens pretty much simultaneously. You need to get the mortgage agreed, the other party has to sign the paperwork then the actual transfer and handover of funds, mortgage etc all happens in one go.

Have a chat with whoever you have engaged to do the conveyancing.
