my ex has changed the court order himself

Hi Zara, the court order states to sell the cottage and a car he took of mine form where i work, the car is on his drive with the engine damaged he said i put no oil in it a lie i have always looked after my cars. and the cottage still not on the market, i went to court 28th july and and cottage still not on the market and car not sold.he said its worth nothing due to scrap.i am sending a garage to look at it this week. he has had a bad back for a long time and has implied that this is the reason for loosing his job as he is a plumber. he has always lied about everything, so i dont know, and wont unless it goes back to court. but if neither of us can aford the mortage, what happens then. i suppose it goes into default. but i know that his girlfriend works and her house up for sale. they are moving to Malta when the cottage sold. (he is Maltese). but he has written this in a letter seperatley (without predudice) so cannot be shown in court. if i cannot aford to go back to court i am stuck, its already cost me £8,000 i have nothing leftl. sorry to say all this, its just nice to talk to someone. Anyway. we are trying to sort out things with letters between us,he wont talk to me on the phone as he says, it the calls cannot be recorded should they be needed in court. (idiot) so everything takes so long. thanks Gilly

Hi Moonbeam,
Dont know about the car, but if the house is in joint names, you can approach an estate agent and ask them yourself to put the house on the market to be sold (if that is what the court order states then that has to be done)
Are there any reasons why you cannot enter the property?
accompanied by an estate agent and get things rolling yourself?

My husband instructed an estate agent, when the ex phoned them to protest, they just said refer it to your solicitor.
She did not do anything about it and the house is nearing sale completion. If he does indeed complain it will be to his solicitor, and they will have a copy of the court order stating that a sale has to take place. So not much he can do. It just comes down to pushing things along for yourself in the end. Otherwise you could sit there for ages if you cannot take it back to court.

Hope that helps a bit, we have been through this just recently.
