Well everyone, it went really really well for us at the FH, my partners ex started ranting and raving at me across the court room, I actually felt quite sorry for her, but hey ho such is life!
Three years it has taken us, sometimes its been sheer hell, if she had settled at the FDR then she would of had 50% of my husbands pension and around 10k cash lump sum! But no, she wanted 75/80% of his pension and a cash lump sum of 45k and nothing was going to change that, nothing!
We had to go to a hearing at 12pm (2 hours before the FH) as I wanted to be an intervenor/ intervener? To protect my interests. The Judge said due to the outrageous offer they had put forward, then it seems clear that I wouldnt of had to be there and she basically said if they dont sort the offer out bearing in mind ALL THAT WAS SAID AT THE ADJOURNED FH, then the cost implications were going to be grave for his ex!
So it was all eventually settled outside the court room before the FH. She settled on 30% of his pension (what it is worth today and not when he retires!!) and a cash lump sum of £2100! (the £100 was her having the last say, me being me shouted after the barrister "if it helps offer 50p on top!)
The
Consent Order was drawn up by her barrister and can you believe this?????????/He brought it out for my hubby to sign, we read it and re-read it ( i dont trust anyone!) my hubby signs it, the barrister comes back out, ready to go in court and says Oh by the way i have just added another sentence, its not much and its a formality!
So we have a look, OH MY GOD he had added the words " something along the lines of " all the above is on the understanding that the husband will not retire before he is 55!!!!!!!!!!!!!!!!!!!! I just could not get my head round it at all, i said to the barrister you can just take that out, how dare you, so your client wants to dictate just that little bit longer does she? NO WAY! What if he gets ill? You want him to crawl into work? Oh my god the cheek of it! My husband had a right go and said unbelievable!
In court the first thing the barrister did was tell the Judge what he had done but she was having none of it either. She said exactly the same things i did, it ended up with my hubby saying what about if i say i will not leave work before 55 voluntary? Me? I dont even like that in it! But at least its now all over for us and we can finally get on with our lives! If he wins the lottery before age 55 we shall just have to do a runner! LOL.
