Had hearing in April, heads of agreement done, signed. Pention figuers done, stbx not returned consent form in time, now judge asked for us to go back to court. Can he put us back to square one. No sign of capital, no atempt by stbx to sell houses, .Can he be made to do anything he agreed to, been at this 2yrs, 12thousand spent, am exhausted and considering running from it all. Any clues please.

Where are you in the game?
Did you go to an FDR hearing at court for your Consent Order ?
Did you both sign a Consent Order?
The Ancillary Relief Protocol is supposed to stop this sort of stuff - effective it ain't - but I don't think you'll be back at the bottom of the ladder again.You reached agreement on and signed something?

Going back to square one is highly unlikely. Usually once the heads of agreement have been signed it is final. The aim is to encourage finality and discourage appeals and applications to be set aside. If consent is withdrawn later the court can make a final order anyway noting that it isn't a ‘consent’ order.

My now x had a court order to make an interim payment of £35,000 by 08/08/08 he told me he didnt recognise it and would be paying. Guess what he didnt! I now cant move my huge mortgage for better rate which was what the order was for
