JJ - forgive me if you've already said - but what are your wife's reasons for applying for costs- has she said?

==She said I had no grounds to contest the agreement or draw out the process, and the judge at the FA actually said I didn’t have much of a case (I haven’t presented all my evidence as yet)==

==I continue to think I had just cause as I had to seek solicitor advice==

I thought we all "went dutch" paid our own costs unless the other side could show industrial strength "litigation misconduct".

==That’s what I’m hoping for==

What happens to District Judges if they believe clients' money is being wasted and allow lost causes to drag on?

==He actually said that some of my questions where irrelevant, but I thought they where, he also didn’t really look at the case and just refereed it to trial==

Are they struck off? Why are they threatening people with the other side's costs?

==It mostly her solicitor threatening me with costs, saying that this will all be over if I pay up…. Unfortunately I don’t have the money anyway so Im stuck having to rely on a FH==

Is it litigation misconduct by the judges?

==No idea==

Is there any mechanism for appealing costs before you have to pay them/at the hearing?

No idea again….

It looks as though judges threaten it but don't do it ?
They don't believe people ensnared in the court process are already under enough pressure to settle?
Who would go to a final hearing if they didn't think they had a cast iron case or were suffering a major injustice?
If it's a question of being badly advised or unaware why aren't the judges fining solicitors or barristers for falling down on the job. Stopping lawyers payments would be a damn sight more effective.

Jack - on what grounds are you contesting the Separation Agreement and what 'Evidence' have you yet to submit??

Judge at my FA mentioned costs to be decided in relation to hearing for Separation Agreement.......

I am self repping and am awaiting paperwork from court (which is one week late because staff who should be typing it up are all away on holiday which I can't afford to go on this year....) to decide 'what actually went on in there' :S
