Outcome of FDA-medical report required

Hi

Would appreciate it if anybody who has been thru a similar experience or knows the procedure could help me.
Had 1st appointment last Friday, I am mentally unwell & am not able to work & am applying for ancillary relief, after my STBX abandoned me for a girl 32yrs younger than him. Reports were filed by my GP who also works as a Psychiatrist, & my Psychotherapist. His sol insisted on an independent report by a Clinical Psychologist & they have given us 21 days to get this report done, which does not seem very much time.
I really don't know what to expect.....

YOur GP may be able to recommend someone to you - or if you have been referred to a specialist, they may be able to help. Make an appt to see your GP asap and explain what has been asked for. YOur solicitor may need to write a letter making the appointment and setting out what sort of report is needed and you will almost certainly have to pay for a report of this nature. Presumably if you are not working you are on incapacity benefit and have been assessed? Hast hat r eport been provided?

I have to say I cannot really see what they hope to achieve by this - except to cost money and cause distress .. but I guess there may be a lot of money at stake if you cannot work and your stbx has to pay spousal maintenance.

As far as deadlines go - in family law they tend to be a bit fluid ... I would say that as long as you have got something in train by the end of 21 days .. ie made an appointment or at least got a recommendation to follow up and can provide evidence.. you'll be fine.

Are your mental health problems a result of your stbx's appalling behaviour? Or do they pre-date that??

Don't let yourself get any worse because of this .... you may find it helpful to write a blog - or at least read other people's. It is amazing how many people out there have thought there was something wrong with them when in fact what was wrong was that they were in a very bad marriage to a person who destroyed their self esteem.

Have not worked for 2yrs as stbx retired in '05 & I gave up work at same time, we were comfortable financially & he has paid me vol spousal maintenance since he left a year ago. As he wants this report to say I can work he has to pay half. Cannot deny I did have a period of depression 10yrs ago which I got over, but all the present stuff has happened since he left me. As it is my GP wanted to see me tomorrow as to how i was after FDA, so will find out more. Will take your advice about the blogs.

your GP sounds like a good un.

Have a look on the site for Section 25 of the MCA - that sets out what is looked at when finances are divided. It includes standard of living.

Yours sounds like a long marriage. Are you very much younger than him?

You are allowed to have been depressed 10 years ago. YOu are allowed to be depresed now. But things will get better.

I feel I have to say something here. I had my FDA last week also and my x2b has asked for a report from a consultant rather than my GP with regards to ME and RA.

My GP wasfurious, as the consultant I had been seeing has retired so it will be a complete stranger who knows nothing of previous history and will be making a snap decision. If I see him on a good day the report would differ hugely from a bad day when I am in constant pain and everything is an effort.

My GP also feels that he is in a better position to give a report as it will cover all issues of my health as he wll have all notes to hand rather than just those specifically relating to M.E.

He has also stated to my solicitor that he is only prepared to put me forward for a consultant with the understanding that my x2b pays for it. Currently the waiting list for seeing an NHS consultant is 3 months or so. Therefore if I go privately my GP feels that X2B should pay as he is insisting. Does this help?

I agree.
Rebus, your GP will have a better idea of what is going on .. that is why you need them to recommend the right person to see for the report - and be sure they have had a proper chat with them so they know what has been going on .. rather than a snap judgement.
