Hi, my question is, what do you think my chances are of getting more than a 50/50 split of assets, I gave up career to take care of our 3 kids, he continued to build his career to a very good "high" level, in mean time im back at work at at the bottom of rung as far as salary goes, he has moved in and cohabiting with high earner, our jointly owned house now paid off and will be sold this spring, so i am the one disadvantaged out of this 23 yr marriage, by way of low income against his very high now joint income.

Do you think this calls for "special circumstance" in the final split of assets, or is the risk of going to court with this too high a financial risk for me?? Any advise, oh and its Scots Law.

Special circumstances are outlined but not definitive in section 10 of Family Law (Scotland) Act....many of the Eng n Wales applications do not apply...however arguement in favour backed with point of law and a person/sol willin to put it across can argue this point in your favour.....best of luck

Will have a read on the section of law that you pointed out.
I definitly think I have got a good case just need to find a "fight for whats right" lawyer who will argue the point on my behalf.
