Hi all.
can anyone advise or help please?
My ex has put in the draft copy of our divorce agreement that I pay for my son till he's 21. He's 19 and going to uni this September.
is this correct? I thought I had to pay for him until 20?
if I sign the draft can I reapply to cms a yr on and they can change it?

You won’t be able to apply to CMS if he is at uni as that is advanced education.

What level of education is he at now? If non-advanced, ie level 3/ A levels or equivalent then you can use CMS.

Why would you want to pay your ex child maintenance for someone not living with her? Don’t have it in your Consent Order and either use CMS or a private agreement based around that. When he goes to uni it will end and you can give him money directly if you choose to.

Hi.
Sorry, I didn’t explain very well. He’s living with his mom.
He’s finished A levels last September. He’s had a yr off and he’s working.
He turns 19 in May, then doing a degree at a local uni for 3yrs to do a degree.
I phoned the Csa yesterday and they said I shouldn’t be paying as he’s now an Adult.
I’m just checking that advice is correct?
I must add that I don’t think everything should be on his moms shoulders, and I would like to contribute to him.

CSA went some years ago, all cases are now on CMS but if your son has finished A levels and is now working then he won’t fall under their remit anyway.

It’s great that you want to contribute to your son to support him but why not just do it directly? If it goes into your consent order then you will have to pay it to his mother. What she chooses to do with it will be none of your business and completely out of your control.

I’d just deal with him directly if it were my decision.
