I’m currently separated from my wife and my 2 children they left the marital home nearly 4 months ago and moved in across the to the mother in laws. I received a letter from my wife’s solicitor stating that she wants as from September the 1st full child maintenance. I’m currently living in the marital home whilst it’s on the market for sale and I’m paying all the bills and the full mortgage. Is this right as she is earning money and getting other benefits? I was under the impression that I wouldn’t start paying for them until the house sells and my wife is not contributing to none of the mortgage or bills

CM is a completely separate issue to sorting out the marital finances. CM is a "statutory obligation" - this means that the parent who has the children for less overnights than the other must pay CM. Where there is a complete shared care arrangement and the child spends equal time with each parent, then CM is not payable.
