My ex and I have a court order (from Dec 2014) which include child maintenance for our 2 children. Twice in the last few months, he has paid me £28 instead of the amount in the order. I suspect he will do so again. He says he was not working, although I don''t know for how long. He is an IT contractor, doing short term contracts, so there are frequently periods between contracts. The maintenance figure was based on his average earnings.
Can I get the court to enforce the order? What would I need to do?
Thank you

Hello Ch94

If you would like to have your court order enforced, you would need to seek legal advice. You may find useful information on that here, www.justice.gov.uk/legal-aid

Usually, once a court order such as this has been in place longer then twelve months, it can be altered or you can make other arrangements. One such arrangement is a statutory arrangement, in which case the Child Maintenance Service would take over the management of your maintenance agreement.

If you would like to receive information about all the options available to you to set up maintenance payments and to receive a more personalised service, you can contact Child Maintenance Options directly, www.cmoptions.org.

The Department for Work and Pensions (DWP) have a web application, ‘Sorting out separation’. It aims to make it much easier for separating and separated parents (and childless couples) to find the support they need, when and where they need it, and encourages them to collaborate on a range of issues.
